IP Safe VPN Terms of Service
These Terms of Service explain how you may use IP Safe VPN’s website, apps, VPN network, accounts, subscriptions, free trial, and related services, together called the “Services”.
By using IP Safe VPN, you agree to these Terms. If you do not agree, please do not use the Services.
About IP Safe VPN
IP Safe VPN is based in South Africa and provides VPN services to users in different countries and regions.
References to “IP Safe VPN”, “we”, “us”, and “our” mean IP Safe VPN and the people and service providers involved in operating the Services.
Who May Use the Services
You must be at least 18 years old, or the age of legal majority in your country or region, to use the Services.
If you use IP Safe VPN on behalf of a company or organisation, you confirm that you are allowed to accept these Terms on its behalf.
Your Account
You are responsible for keeping your account login details secure.
You are also responsible for activity that happens under your account.
Please do not share, sell, rent, or resell your account unless your plan specifically allows it.
Each user may only create and use one account, unless we approve otherwise in writing. You may not create multiple accounts to obtain additional free trials, avoid payment, bypass device limits, or get around account restrictions.
If we believe an account is being used in a way that is fraudulent, harmful, unlawful, or against these Terms, we may limit, suspend, or close the account.
Using IP Safe VPN
You may use IP Safe VPN for lawful personal or business purposes during a valid free trial or active paid subscription, depending on your plan.
To keep IP Safe VPN safe and reliable for everyone, you agree not to use the Services to:
- break the law;
- attack, disrupt, scan, or overload websites, networks, devices, or services;
- send spam or abusive messages;
- commit fraud, phishing, identity theft, or other deceptive activity;
- distribute viruses, malware, or harmful software;
- infringe copyright, trademarks, privacy rights, or other rights;
- harass, threaten, abuse, or harm others;
- access, share, or distribute unlawful or harmful content;
- bypass restrictions in a way that breaks the law or another service’s terms;
- interfere with IP Safe VPN’s systems or security.
If we believe the Services are being misused, we may take reasonable action to protect IP Safe VPN, our users, and third parties.
VPN Service Limitations
IP Safe VPN is designed to improve your privacy and security online, but no VPN can guarantee complete anonymity, complete security, or access to every website or service.
Some websites, apps, platforms, streaming services, payment services, or networks may block or restrict VPN traffic.
VPN speed, availability, server access, and performance may vary depending on your device, location, internet connection, server load, network conditions, and other factors outside our control.
We may add, remove, change, or limit servers, locations, IP addresses, protocols, apps, or features from time to time.
Paid Service, Free Trial, and Payments
IP Safe VPN is a paid subscription service. We may offer a free trial so that new users can try the Services before purchasing a subscription.
Free trials are intended for genuine new users. We may limit or cancel a free trial if we believe it is being misused, including through duplicate accounts, repeated sign-ups, false information, payment abuse, device abuse, or attempts to bypass trial limits.
After the free trial ends, continued access to the Services requires a paid subscription.
By purchasing a subscription, you agree to pay the price shown at checkout, including any applicable taxes or charges.
Subscription details, including prices, device limits, trial periods, renewal terms, and included features, are shown on our website, app, checkout page, or app store listing.
Unless stated otherwise, subscriptions may renew automatically until cancelled.
You are responsible for cancelling your subscription before renewal if you do not want to be charged again.
If your payment fails, is reversed, or is charged back, we may suspend or cancel your access to the Services.
Cancellations
You may cancel your subscription at any time using the available cancellation method, such as your account page, app store subscription settings, payment provider settings, or by contacting support.
Cancelling stops future renewals. It does not automatically refund payments already made, unless required by law or stated in our Refund Policy.
Deleting the app from your device does not always cancel your subscription. You are responsible for cancelling through the correct billing method.
Refunds
Refunds are handled according to our Refund Policy.
Refunds are only available for your first payment to IP Safe VPN, unless required otherwise by law or stated in our Refund Policy.
Renewal payments, repeat payments, additional payments, and payments made after the first payment are non-refundable, unless required by law or stated in our Refund Policy.
If you purchased through Apple App Store, Google Play, or another app store, refund requests may need to be made directly through that store and will be handled according to that store’s rules.
We may refuse a refund if we reasonably believe there has been misuse, fraud, breach of these Terms, chargeback abuse, excessive use of the Services, or an attempt to bypass our subscription, payment, account, device, or trial controls.
Privacy
Your privacy is important to us.
Our Privacy Policy explains what information we collect, how we use it, how we protect it, when we may share it, and what rights you may have.
IP Safe VPN is based in South Africa. We process personal information in accordance with applicable privacy and data protection laws, including POPIA, GDPR, UK GDPR, and similar laws where they apply.
By using the Services, you acknowledge that your personal information will be handled as described in our Privacy Policy.
Security and Fair Use
We may use reasonable checks and security measures to protect IP Safe VPN, our users, our systems, and third parties.
This may include checks related to accounts, payments, devices, IP addresses, fraud prevention, abuse prevention, and service security.
Please do not try to bypass, disable, manipulate, or interfere with these checks.
Intellectual Property
The IP Safe VPN name, logo, website, apps, software, systems, designs, content, and related materials belong to IP Safe VPN or our licensors.
You may not copy, modify, reverse engineer, resell, distribute, or create derivative works from the Services, except where allowed by law.
You may not use our name, logo, branding, or content without our written permission.
Changes to the Services
We may update, improve, change, suspend, or discontinue parts of the Services from time to time.
We may also release app updates that are required for the Services to continue working properly.
We are not responsible for losses caused by service changes, maintenance, interruptions, outages, or discontinued features.
Third-Party Services
The Services may depend on third parties, such as app stores, payment processors, hosting providers, server providers, support tools, and internet infrastructure providers.
We are not responsible for third-party services, outages, policies, actions, or content.
Your use of third-party services may be subject to their own terms and privacy policies.
Disclaimer
The Services are provided on an “as is” and “as available” basis.
To the fullest extent allowed by law, we do not guarantee that the Services will always be available, uninterrupted, secure, error-free, fast, or suitable for every purpose.
We also do not guarantee access to any specific website, app, platform, country location, server, IP address, protocol, or online service.
Limitation of Liability
To the fullest extent allowed by law, IP Safe VPN will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business, service interruption, or third-party claims.
To the fullest extent allowed by law, our total liability for any claim relating to the Services or these Terms will not exceed the amount you paid to IP Safe VPN for the Services during the three months before the claim arose.
Nothing in these Terms limits liability where it would be unlawful to do so.
Suspension and Ending Access
We may limit, suspend, or end access to the Services if:
- you breach these Terms;
- your payment fails, is reversed, or is charged back;
- we believe there is misuse, fraud, unlawful activity, or a security risk;
- your use creates risk for IP Safe VPN, our users, our systems, or third parties;
- we are required to do so by law, a regulator, court order, app store, payment provider, or service provider.
You may stop using the Services at any time.
Legal Compliance
You are responsible for making sure your use of IP Safe VPN is legal in your country, region, and current location.
Please do not use the Services where VPN use is illegal or restricted, or where you are prohibited from using the Services under applicable law.
Changes to These Terms
We may update these Terms from time to time.
If we make important changes, we will take reasonable steps to let users know, such as posting the updated Terms on our website or in the app.
The updated Terms will apply from the date they are posted, unless a later date is stated.
Your continued use of the Services after the updated Terms take effect means you accept the updated Terms.
Governing Law
IP Safe VPN is based in South Africa, so these Terms are governed by the laws of the Republic of South Africa.
However, if you live in another country or region, you may have mandatory consumer, privacy, electronic communications, or other legal rights that apply regardless of this section. Nothing in these Terms is intended to limit those rights.
If a dispute arises from or relates to these Terms or the Services, the parties agree to the jurisdiction of the courts of South Africa, unless applicable law gives you the right to bring a claim in another country or forum.
General
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will still apply.
If we do not enforce part of these Terms immediately, this does not mean we give up the right to enforce it later.
These Terms, together with our Privacy Policy, Refund Policy, and any subscription, payment, or purchase terms shown at checkout, form the agreement between you and IP Safe VPN.
